4. SMS / Text Messaging Policy

Message and data rates may apply depending on your mobile carrier and plan. App Funding Beta LLC is not responsible for any charges assessed by your mobile carrier. Please contact your carrier for details on your messaging plan.
4.4 Opt-Out
You may opt out of SMS messages at any time by replying STOP to any message you receive from us. You will receive a single confirmation message after opting out. Opting out of marketing messages will not affect transactional messages required in connection with your active MCA agreement.

5.1 Use of Plaid Services
App Funding Beta LLC uses Plaid Inc. (“Plaid”) to securely access your business bank account(s) for purposes of verifying account ownership, monitoring account balances, and facilitating MCA payment collections via ACH debit. By linking your bank account through Plaid, you acknowledge that Plaid will access and transmit your financial data to us in accordance with Plaid’s End User Privacy Policy, available at https://plaid.com/legal.
5.2 Financial Information Collected
When you connect your bank account through Plaid, we may collect:
- Bank account name, type, routing number, and account number
- Current and available account balance information
- Transaction history (deposits, withdrawals, and transfers)
- Account holder identity information as provided by your financial institution
- Institution name and account status
5.3 How We Use Financial Data
Financial data collected through Plaid is used exclusively for:
- Verifying bank account ownership and authenticity during merchant onboarding and underwriting
- Monitoring account balances to determine appropriate timing for ACH debit collections under your MCA agreement
- Facilitating ACH debits authorized under your signed MCA agreement
- Assessing merchant financial health for ongoing risk management

- Complying with applicable laws and our contractual obligations
5.4 Financial Data Sharing
Your financial data may be shared only in the following limited circumstances:
- With Plaid, as necessary to maintain your bank connection and retrieve updated financial data
- With our processing bank (USIO) and ACH processor as required to execute payment transactions authorized under your MCA agreement
- With regulatory authorities, law enforcement, or courts when required by law, subpoena, or court order
- With legal, audit, or accounting advisors under binding confidentiality obligations
- With purchasers or assignees of your MCA agreement, in connection with a permitted assignment
5.5 Plaid Disconnection
You may disconnect your bank account from Plaid by contacting us at info@appfundingbeta.com or (646) 360-0790, or by managing your connections at https://my.plaid.com. Disconnecting your bank account while an MCA agreement is active may constitute an Event of Default under that agreement and may trigger acceleration of the outstanding balance and applicable default remedies.
5.6 Financial Data Retention
Financial data is retained for the duration of your active MCA agreement and for any additional period required by law, regulation, or our contractual obligations. You may request information about your retained data by contacting us at info@appfundingbeta.com.
6. Sharing of Personal Information
We do not sell, rent, or trade your personal information to third parties for their own marketing purposes. We may share your information only in the following circumstances:
- Service Providers: Trusted vendors who provide services on our behalf, including payment processing, bank account verification (Plaid), document management, e-signature platforms, and CRM services, under contractual confidentiality and data protection obligations.
- ISO Brokers and Referral Partners: We may share limited deal-level information with the ISO broker or referral partner who submitted your application, to the extent necessary for commission calculation and deal management. ISO partners do not receive your full personal file without authorization.
- Payment Networks and Financial Institutions: As required to process ACH transactions and maintain your merchant account.
- Legal and Regulatory Compliance: When required by law, subpoena, court order, or government regulation.
- Business Transfers: In connection with a merger, acquisition, financing, or sale of Company assets, your information may be transferred as part of that transaction.
- With Your Consent: For any purpose for which you have given express written consent.
7. Data Security
We implement commercially reasonable administrative, technical, and physical safeguards designed to protect your personal information from unauthorized access, use, or disclosure.
